PRIVACY POLICY

This Privacy Policy explains how we collect, use, share, and protect your personal information when you visit momentumbaseball.shop (the "Site"), buy from us, sign up for our emails or text messages, or otherwise interact with us.
It applies to the following affiliated companies, which share common management, a common website, and common operational systems (together, "we," "us," or "our"):
- Momentum Films LLC, which operates the Momentum brand, including gloves, bats, apparel, baseballs, rosin, and Momentum media and content
- Outage LLC, which operates the Bauer Outage brand, including limited-release gloves and rosin
- 4APP Sports LLC, which operates the 4APP pitching training platform
A note on 4APP. The 4APP platform and mobile application have their own privacy policy, available on the 4APP website and in the app's App Store listing. This policy does not cover your use of the 4APP app or platform. It covers 4APP Sports LLC only to the extent that it uses the Site, shares our customer and marketing systems, or sells digital products through the Site.
We refer to the Site and our related services together as the "Services." Each company is responsible for the personal information collected under its own brand, and we share information among these companies as described in Section 3.
Read this alongside our Terms of Service. If you do not agree with this policy, please do not use the Services.
1. Information we collect
Information you give us
- Order information. Name, billing address, shipping address, payment information (processed by our payment providers, we do not store full card numbers), email address, and phone number.
- Account information. If you create an account: your name, email address, password, order history, and saved preferences.
- Marketing information. Email address, mobile phone number, and the record of when and how you consented to receive messages from us, including which brands that consent covers.
- Support and communications. Anything you send us by email, text, chat, direct message, or phone, including sizing questions, glove specs, warranty claims, and return requests.
- Content you submit. Product reviews, photos, videos, contest, raffle, waitlist, and giveaway entries, and anything you post to our community areas.
- Affiliate, creator, and partner information. If you join an affiliate or referral program: name, contact details, payout information, and tax details where required.
Information we collect automatically
When you use the Services we collect information about your device and how you use them. We call this Device Information. It includes your browser type, IP address, time zone, operating system and device model, referring URLs and search terms, pages and products viewed, time on page, and click behavior.
We collect this using:
- Cookies. Small data files placed on your device, often with a unique identifier. You can manage cookies through your browser settings and through our cookie preferences tool.
- Log files. Records of activity across the Services including IP address, browser type, internet service provider, referring and exit pages, and timestamps.
- Pixels, tags, and web beacons. Electronic files and code that record how you browse and how you respond to our ads and emails, including whether you opened an email or clicked a link.
Shopping cart and abandoned cart tracking
The Site uses cookies to help keep track of items you put into your shopping cart, including when you have abandoned your cart. This information is used to determine when to send cart reminder messages by email and by text message. If you have given us your email address or mobile number and consented to receive messages, we may use this cart activity to send you a reminder about the items you left behind. You can stop these reminders at any time using the opt-out methods in Sections 4 and 5.
Information from third parties
We may receive information about you from Shopify, Klaviyo, our payment processors, shipping carriers, advertising platforms, and analytics providers. If you interact with us on social media or through a creator, affiliate, or referral link, we may receive limited information from that platform.
2. How we use your information
We use your information to:
- Fulfill and ship your order, process payment, and send invoices and order confirmations
- Deliver any digital products or courses you purchase through the Site
- Provide customer service, handle returns, exchanges, and warranty claims
- Screen orders and accounts for fraud and payment risk
- Send you transactional messages, including order updates, shipping and delivery notifications, and account or security alerts
- Send you marketing messages, including product drops, restock alerts, and abandoned cart reminders, but only where you have given us the consent described in Sections 4 and 5
- Improve and optimize the Services, including merchandising, page speed, and checkout
- Measure the performance of our marketing, advertising, affiliate, and sponsorship campaigns
- Personalize what you see, including product recommendations and ads
- Produce aggregated or de-identified analytics that do not identify you
We also use information to comply with legal obligations, enforce our terms, and protect our rights and the rights of our customers.
3. How we share your information
We share personal information with service providers who help us run the business. We do not sell your personal information for money.
The categories of information we share, and who we share them with:
- Identifiers (name, email, phone, IP address, account ID) with Shopify, Klaviyo, shipping carriers, and customer service tools, for order fulfillment, communications, and fraud screening.
- Commercial information (products purchased, order history, returns) with Shopify, payment processors, and accounting and tax providers, for fulfillment, accounting, and warranty.
- Payment information (billing address, card details) with our payment processors, for payment processing. We do not store full card numbers.
- Internet activity (pages viewed, clicks, referral source, cart activity, email opens) with analytics and advertising platforms, for optimization and advertising measurement.
- Approximate location (derived from IP address) with analytics, advertising, and fraud prevention providers, as described in Section 6.
- Inferences (product interests, likelihood to purchase) with advertising platforms, for personalized advertising.
Sharing among our companies. Momentum Films LLC, Outage LLC, and 4APP Sports LLC share customer, order, and marketing information with one another so we can operate a single customer service, fulfillment, fraud prevention, and account infrastructure across all three brands on one website. This means an order you place with one brand may be visible to the others. Marketing to you from a brand other than the one you bought from is governed by the consent rules in Sections 4 and 5.
Named providers we currently rely on include Shopify (store platform, see shopify.com/legal/privacy), Klaviyo (email and text messaging, see klaviyo.com/legal/privacy), Google Analytics (see policies.google.com/privacy, opt out at tools.google.com/dlpage/gaoptout), and Meta, Google, and other advertising platforms.
We may also disclose personal information to comply with applicable laws, to respond to a subpoena, search warrant, or other lawful request, to protect our rights, or in connection with a merger, acquisition, financing, or sale of business assets.
The above excludes text messaging originator opt-in data and consent. This information will not be shared with any third parties.
4. Email marketing
If you sign up for our emails, we will send you promotions, product launches, drop and restock alerts, abandoned cart reminders, content, and offers.
- We only send marketing email to people who have given us consent, or where we are permitted to email you based on an existing business relationship under applicable law.
- When you sign up, we tell you which brands your consent covers. If you consent to hear from Momentum, Bauer Outage, and 4APP, you may receive email from all three. If you consent to only one, we will only email you about that brand.
- Every marketing email identifies the sending company, includes our mailing address, and includes a one-click unsubscribe link.
- You can unsubscribe at any time using the link in any email, or by emailing support@momentumbaseball.shop. You can unsubscribe from one brand and stay subscribed to the others. We process unsubscribe requests within 10 business days and usually much faster.
- Unsubscribing from marketing does not stop transactional messages about an order or your account.
Canadian recipients. We comply with Canada's Anti-Spam Legislation (CASL). We obtain express or implied consent before sending commercial electronic messages, we identify the sending company in every message, and we provide an unsubscribe mechanism that works for at least 60 days after the message is sent. We keep records of consent.
5. Text message program
This section covers our text messaging program. It applies to mobile numbers you give us for marketing or notification purposes.
Consent
By providing your mobile number and checking the SMS consent box, you agree to receive recurring automated marketing and transactional text messages at the number provided from the brands identified at the point of signup. Where the signup form names Momentum, Bauer Outage, and 4APP, your consent covers all three, and messages may be sent by Momentum Films LLC, Outage LLC, or 4APP Sports LLC. Where the signup form names only one brand, your consent covers only that brand.
Consent is not a condition of any purchase. Your phone number is never a required field on a form where text message consent is collected.
What we send and how often
We send order and shipping updates, drop and restock alerts, promotions, abandoned cart reminders, and customer service replies. Message frequency varies.
Cost
Message and data rates may apply. Your mobile carrier is not liable for delayed or undelivered messages.
Opting out and getting help
- Reply STOP to any message to opt out. You will receive one confirmation message and then no further marketing texts from that brand.
- Reply HELP for help, or email support@momentumbaseball.shop.
- We process opt-out requests within 24 hours.
What we collect for text messaging
Your mobile phone number, records of how and when you consented and which brands that consent covers, the messages sent and received, your responses including STOP and HELP keywords, and cart and browsing activity used to trigger reminder messages as described in Section 1.
How we handle your mobile information
We do not sell, rent, or share your mobile phone number or your text message opt-in consent data with any third parties or affiliates for marketing or promotional purposes.
All other categories of data sharing described in this Privacy Policy, including the sharing among our companies described in Section 3, exclude text messaging originator opt-in data and consent. This information will not be shared with any third parties.
We share your mobile number only with Klaviyo and other subcontractors or service providers bound by confidentiality obligations, and only so they can deliver messages, provide customer support, or operate the technical parts of our text message program on our behalf.
Retention
We keep your mobile number and consent record for as long as you are subscribed. After you opt out, we keep your number on a suppression list indefinitely so we can honor your opt-out, and we keep the consent record for at least five years to demonstrate compliance.
Canadian recipients
Text messages are commercial electronic messages under CASL. The consent, identification, and unsubscribe requirements in Section 4 apply to our text message program as well.
6. Location information
We collect approximate location information derived from your IP address, and the shipping and billing addresses you provide when you place an order. We do not collect precise GPS or device-level background location, and we do not run location-based services or geofencing.
We use approximate location to:
- Estimate shipping costs and delivery times, and display the shipping options available in your region
- Display prices and currency relevant to your region
- Calculate and comply with regional sales tax obligations
- Determine which drops and releases are available in your region
- Screen orders for fraud and payment risk
- Understand where our customers are located so we can plan inventory, product drops, and marketing
We share approximate location with the analytics, advertising, and fraud prevention providers named in Section 3. We do not sell location data, and we do not use your location to trigger text messages based on where you physically are.
7. Advertising and cookies
We use your information to show you ads that we think are relevant, including ads for any of our brands. To learn how targeted advertising works, visit the Network Advertising Initiative's page at networkadvertising.org/understanding-online-advertising/how-does-it-work.

Sharing your personal information with advertising platforms for cross-context behavioral advertising may be considered "sharing" or a "sale" under some state privacy laws. See Section 9 for how to opt out.
This does not apply to your text message opt-in data, which we never share for advertising.
8. Opt-out preference signals
We honor the Global Privacy Control (GPC) and other recognized universal opt-out mechanisms. If your browser or extension sends one of these signals, we treat it as a request to opt out of the sale or sharing of personal information from that browser or device.
We do not currently respond to legacy "Do Not Track" browser signals, as there is no common industry standard for them.
9. Your privacy rights
United States
Depending on where you live, you may have the right to:
- Know what personal information we collect, use, and disclose
- Access a copy of your personal information
- Correct inaccurate personal information
- Delete your personal information
- Receive your personal information in a portable format
- Opt out of the sale or sharing of personal information for targeted advertising
- Opt out of profiling that produces legal or similarly significant effects
- Limit the use of sensitive personal information
- Not be discriminated against for exercising these rights
These rights apply to residents of states with comprehensive privacy laws in effect, currently including California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia. Specific rights vary by state.
To exercise a right, email info@momentumbaseball.shop with the subject line "Privacy Request," or use the "Do Not Sell or Share My Personal Information" link in our Site footer. Tell us which brand or brands your request covers. If you do not specify, we will treat it as covering all three. We will verify your identity before acting, usually by confirming information associated with your account or orders. You may use an authorized agent, and we may ask for proof of their authority.
We respond within 45 days and may extend once by another 45 days where permitted. If we deny your request, you may appeal by replying to our response. We will inform you of the outcome within 45 days and, where required, tell you how to contact your state attorney general.
Canada
Under PIPEDA and applicable provincial law, you may request access to the personal information we hold about you, ask us to correct it, and withdraw consent to our use of it, subject to legal and contractual limits. Contact us at info@momentumbaseball.shop. If you are not satisfied with our response, you may contact the Office of the Privacy Commissioner of Canada at priv.gc.ca.
Europe and the United Kingdom
If you are in the EEA, UK, or Switzerland, you have the right to access, correct, delete, restrict, or object to our processing of your personal information, and the right to data portability. We process your information to perform our contract with you, to comply with legal obligations, based on your consent for marketing, and based on our legitimate interests in operating and improving our business.
Your information will be transferred outside your country, including to Canada and the United States. Where required, we rely on Standard Contractual Clauses or other approved transfer mechanisms.
You may lodge a complaint with your local supervisory authority.
10. Data retention
We keep personal information only as long as we need it:
- Order information: seven years, to meet tax, accounting, and warranty obligations
- Account information: for as long as your account is active, plus two years
- Email marketing consent records: for as long as you are subscribed, plus three years after you unsubscribe
- Text message numbers and consent records: as described in Section 5
- Suppression and opt-out lists: indefinitely, so we can continue to honor your opt-out
- Customer service records: three years
- Analytics, cart, and device information: up to 26 months
We may keep information longer where required by law or where needed to resolve a dispute or enforce our agreements.
11. Children and minors
The Services are not directed to children under 13, and we do not knowingly collect personal information from anyone under 13. If you are under 13, do not use the Services or give us any personal information.
Our products are used by youth baseball players. Where a purchase is made for a young player, we expect a parent or legal guardian to complete the transaction and provide any information required.
We do not knowingly sell or share the personal information of anyone under 16 for targeted advertising without the consent required by applicable law.
If you believe we have collected information from a child under 13, or you are a parent or guardian who wants to review or delete information about your child, contact us at info@momentumbaseball.shop and we will act on it.
12. Security
We use administrative, technical, and physical safeguards to protect your personal information, including encryption in transit, access controls, and vetting of the vendors we use. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
13. Changes to this policy
We may update this policy to reflect changes in our practices or for operational, legal, or regulatory reasons. When we make material changes we will update the "Last updated" date and, where required, notify you directly.
